Advisory Opinion Request 2016-23 (Socialist Workers Party) 

On March 17, the Commission received an Extension of Time until April 21.

Enforcement

The Commission made public two closed cases, as follows. For more information, see the case documents in the Enforcement Query System.

MUR 7060

  • COMPLAINANT: Gabriela M. Mosquera
  • RESPONDENTS: Alex Law for Congress and Rishav Kohli, in his official capacity as treasurer (the Committee); and Alex Law
  • SUBJECT: The complaint alleged that Law and the Committee improperly used federal campaign funds to create and distribute campaign literature that featured local candidates running on the same ticket. Law was a 2016 candidate for New Jersey’s 1st Congressional District.
  • DISPOSITION: The Commission found no reason to believe a violation occurred because under the Federal Election Campaign Act of 1971, as amended, donations to state and local candidates are a permissible use of campaign funds, subject to the provisions of state law.

MUR 7086

  • COMPLAINANT: FEC-Initiated
  • RESPONDENTS: Stop Hillary PAC and Dan Backer, in his official capacity as treasurer (the Committee)
  • SUBJECT: In the normal course of carrying out its supervisory responsibilities, the Commission initiated proceedings to determine whether the Committee improperly included the name of a federal candidate in its name.
  • DISPOSITION: The Commission agreed to enter into a conciliation agreement providing for the Committee to pay a civil penalty of $5,500.

Administrative fines

The Commission made public two campaign finance enforcement matters that were resolved through its Administrative Fines (AF) program, as follows. For more information, see the case documents in the Enforcement Query System.

AF 3128 

Fetterman for Senate and Phyllis Greathouse-Brown, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $6,010.

AF 3140  

Denali Leadership PAC and Kimberly Van Wyhe, in her official capacity as treasurer. The Commission made a final determination and assessed a civil penalty of $3,500.
